Terms of Service – Working Proof

This Agreement sets out the terms under which Working Proof (“Studio,” “we,” “our,” or “us”) provides podcast recording services and use of our facilities and equipment. By booking a session, you (“Client”) agree to the terms below.
1. Definitions
Client – The person or entity booking studio time, along with any guests, contractors, or team members they bring.
Studio – Working Proof, located at 260 Carlaw Avenue, Unit #202A, Toronto, Ontario.
Management – Camco Media Corp., the owner, and 115creative, the operator of the Studio.
Equipment – All microphones, headphones, mixers, recorders, cameras, lights, computers, software, furniture, or other items provided by the Studio for use during the Client’s session.
2. Booking and Payment
Full payment is required at the time of placing your appointment.
Bookings are only confirmed after payment is processed.
Clients must be of legal age to enter into this Agreement. Minors must have a legal guardian book on their behalf.
3. Cancellations and Rescheduling
More than 48 hours’ notice: One complimentary reschedule permitted. Additional changes are subject to a 50% rebooking fee.
Less than 48 hours’ notice or no-show: Full session fee is forfeited, no negotiations.
In the event of cancellation, studio credit will be applied for use toward a future re-booking.
If the Client does not intend to re-book, refunds may be issued as follows: booking value minus a 5% merchant fee, minus any expenses already incurred by Management for the Client booking or required to process the refund.
4. Studio Rules
Clients must follow all rules while in the Studio:
No smoking, vaping, or open flames
Food and/or drink allowed only in the kitchen
Guests not appearing on camera must silence cell phones and remain quiet or risk being asked to leave
Do not tamper with wiring, mixers, software, or settings without Management approval
Keep guest counts within agreed limits
5. Equipment Use
Equipment must be handled with care. Only Management or approved Clients may operate recording gear.
Any damage caused by misuse will be billed to the Client at replacement or repair cost.
Certain equipment may require prior approval or staff operation.
6. Overtime
Sessions start and end at their scheduled times.
Exceeding booked time will result in overtime fees billed at the hourly rate (or higher if another Client is delayed).
To avoid issues, Clients are encouraged to arrive 30 minutes early for preparation.
7. Files and Deliverables
Unless otherwise arranged, raw recordings are delivered as-is after the session.
Edited or synchronized audio/video files, mixing, or post-production are separate services available for purchase.
Management is not responsible for storing or archiving files after delivery.
Final deliverable files are stored in the cloud for up to 72 hours. Clients must download and back up their media within this window, after which files are permanently deleted.
8. Content Responsibility
Client is solely responsible for the content recorded, including securing all necessary rights, permissions, and releases.
Management is not liable for copyright infringement, defamation, or other claims related to recorded material.
9. Service Interruptions
Management is not liable for disruptions outside its control, including but not limited to:
Power outages, internet failures, or technical malfunctions
Construction or noise from neighbouring units
Illness or emergencies affecting staff availability
If Management cannot provide the Studio in usable condition, the Client may receive a refund or credit. Liability ends there. Management is not responsible for any expenses incurred beyond the studio booking, including travel, lodging, or guest fees.
10. Liability and Indemnity
Clients assume full responsibility for themselves, their guests, and their belongings.
Management is not liable for injuries, damages, or losses occurring during or after use of the facilities.
By booking, Clients agree to hold Management harmless from any claims arising from use of the Studio.
All expenses outside of the Client’s booking are the Client’s sole responsibility, and the Client agrees to indemnify and hold Management harmless against any damages arising from service disruption, modification, cancellation, or otherwise.
11. Changes to Agreement
Management reserves the right to update these Terms of Service at any time. The current version will always be posted on the Studio’s website. Continued use of the Studio constitutes acceptance of updated terms.
12. Confirmation
By placing a booking with Working Proof—whether through the website, phone, text, email, or otherwise—the Client confirms they have read, understood, and irrevocably agreed to these Terms of Service.
